WHEREAS, this agreement is entered into by and between Henry Anne and Freddie Copps, owners of The Jacobs Ranch, located in LaSalle County, Texas

WHEREAS, the undersigned understands and recognizes that the hunting of game animals or birds or fishing or hiking in the pastures is inherently dangerous within itself and accepts and assumes the risk and voluntarily goes on the hunt acknowledging the danger of hunting.

NOW, THEREFORE, for and in consideration to participate in this hunt and other good and valuable consideration, the undersigned does hereby release and agrees to hold harmless the families of the Jacobs Ranch, together with their agents, employees, assigns, principals, and representatives against any damage, negligence or claim whatsoever, including, without limitation, claims for personal injury or death to, and/or damage to personal property of the undersigned and does hereby bind the undersigned's heirs, successors, assigns, executors and administrators.

This agreement to Release and Hold Harmless in favor of The Jacobs Ranch and all members of the family shall be absolute and shall apply to any injury, death, or damage arising in any way out of the undersigned's participation in any activity while on the premises or property of The Jacobs Ranch and shall apply to any activity, injury, damage or harm related in any manner regardless of whose negligence, if any, that may be a proximate cause of such injury, damage or harm.

The undersigned further agrees that in the event the undersigned or any of his heirs, executors, administrators, successors or assigns should ever pursue any claim or litigation against The Jacobs Ranch or any members of the family for the death or personal injury of the undersigned arising during the hunt or while on these premises, then, in such event, the undersigned agrees to indemnify and defend and in the event of a judgment pay such judgment together with all attorney's fees and expenses incurred and otherwise indemnify The Jacobs Ranch and any member of the family for all damages, expenses and attorney fees that may be incurred. In the event The Jacobs Ranch or any members of the family are required to defend any such litigation, and the undersigned or his estate fail to indemnify and/or defend, the undersigned agrees that he shall confess judgment in favor of The Jacobs Ranch and any members of the family to the full extent of any judgment, expenses and attorney fees. Nothing in this paragraph shall be construed as a waiver of the parties' intention or other rights to pursue all other relief they are entitled. This Release and Hold Harmless Agreement does bind the undersigned's heirs, successors, assigns, executors and administrators.
