ACCEPTABLE USE POLICY

The purpose of GrandeRiver.Net is to provide commercial grade computer connectivity to its Customers and Customer Support when needed. This Policy Statement represents a guide to the acceptable use of the GrandeRiver.Net backbone by its Customers and to the expectations and requirements for the acceptable use of that backbone by the Customers. All policies stated herein are subject to change upon fifteen (15) days prior written notice.

Any violation of the GrandeRiver.Net Acceptable Use Policies or other unacceptable use of the GrandeRiver.Net backbone by the Customer, as determined in the sole and exclusive discretion of GrandeRiver.Net, shall be subject to immediate termination or suspension of all GrandeRiver.Net products and services.

1. All use must be consistent with the purposes of GrandeRiver.Net as set forth in the first paragraph above. All use must be permitted by applicable local, state, and federal laws. The customer may not use GrandeRiver.Net services to conduct any business or activity or solicit the performance of any activity that is prohibited by law.

2. All data traveling onto other network backbones via iver.Net consistent with the purposes and policies of those backbones.

3. All USENET traffic originating from or being received by GrandeRiver.Net, unless explicitly allowed by the charter of a newsgroup or mailing list, must, at a minimum, conform to, but is not limited to, the following:

4. Junk mailing or bulk mailing of advertising or any other electronic information is expressly forbidden unless all recipients of the information have either requested the information or explicitly given permission to receive the messages.

5. All use must comply with accepted Net Etiquette.

6. Any use of Products and Services deemed, in the sole discretion of GrandeRiver.Net, to be destructive, obstructive, or otherwise contrary to these Policies, including, but not limited to, any data or information that could interfere with standard bandwidth utilization or business practices of GrandeRiver.Net, shall be subject to immediate termination of access and services. In the event of any termination of access or services, GrandeRiver.Net shall not be responsible for the forwarding of any E-mail, preservation of data stored on the GrandeRiver.Net systems, losses of connectivity or any other losses, direct or indirect, consequential, or otherwise associated therewith.

7. Any use of GrandeRiver.Net resources that disrupts the normal use of the system for other GrandeRiver.Net customers is considered, in the sole discretion of GrandeRiver.Net, to be abuse of system resources and shall be subject to immediate termination of access and services. In the event of any termination of access or services, GrandeRiver.Net shall not be responsible for the forwarding of any E-mail, preservation of data stored on the GrandeRiver.Net systems, losses of connectivity or any other losses, direct or indirect, consequential, or otherwise associated therewith.

8. GrandeRiver.Net reserves the right to monitor any and all use of the GrandeRiver.Net system, including, but not limited to, WWW, HTTP, FTP, WAIS, GOPHER or any other widely available data residing in the Customer's private areas on the GrandeRiver.Net computer systems.

9. The Customer shall not violate any copyright, patent, trademark or other proprietary rights in their use or posting of information to the Internet through the GrandeRiver.Net backbone. The Customer shall be responsible for any and all such violations or infringements and shall hold GrandeRiver.Net harmless therefrom.

10. Any and all use of the GrandeRiver.Net System that is viewed by the greater USENET culture will be reviewed, and for any violation of the accepted Policies, the Customer will be instructed to cease all related actions and/or be subject to immediate termination as provided herein.

11. Unless otherwise agreed, the Customer's right to use the GrandeRiver.Net service or to designate users is not transferable and is subject to any limits established by GrandeRiver.Net.

12. Multiple members of the same household may share a single User ID Name. However, only one person is authorized to access the GrandeRiver.Net service at any given time using the User ID Name. Additional E-mail addresses do not allow for multiple users to access the GrandeRiver.Net service at the same time.

13. The Software provided by GrandeRiver.Net may include shareware and any licensing requirements shall be the responsibility of the Customer.

14. CUSTOMER EXPRESSLY AGREES THAT USE OF THE GrandeRiver.Net SERVICE IS AT THE CUSTOMER'S SOLE RISK. NEITHER GrandeRiver.Net, ITS EMPLOYEES, OFFICERS, DIRECTORS, AFFILIATES, AGENTS, THIRD PARTY INFORMATION PROVIDERS, MERCHANTS, LICENSORS OR THE LIKE, WARRANT THAT THE GrandeRiver.Net SERVICE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE GrandeRiver.Net SERVICE, OR AS TO THE ACCURACY , RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH THE GrandeRiver.Net SERVICE. THE GrandeRiver.Net SERVICE IS PROVIDED ON AN "AS IS," "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED. GrandeRiver.Net MAKES NO WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED WITH RESPECT TO THE SOFTWARE PROVIDED. IN NO EVENT SHALL GrandeRiver.Net BE LIABLE TO YOU OR ANY THIRD PARTY FOR CONSEQUENTIAL, SPECIAL, INDIRECT OR INCIDENTAL DAMAGES WHICH MIGHT RESULT FROM USING THE SHAREWARE SOFTWARE, INCLUDING, BUT NOT LIMITED TO, LOSS OF INFORMATION OR MATERIAL OF ANY KIND.

THE CUSTOMER UNDERSTANDS THAT ENROLLMENT AND USE OF THE GrandeRiver.Net SERVICE CONSTITUTES AN AGREEMENT TO BE LEGALLY BOUND AND TO ABIDE BY THE TERMS OF THE GrandeRiver.Net ACCEPTABLE USE POLICY.
